A former employee of Marks and Spencer has won a legal battle after he was dismissed due to the misuse of his staff discount by his wife. In a recent ruling, the dismissal was deemed ‘disproportionate’ by the Workplace Relations Commission (WRC).
The incident arose when the employee’s wife copied his discount credentials and distributed them among her family and friends. This led to 73 transactions over a six-week period without his awareness. Despite the breach of company policy, the WRC found that the termination of his employment was excessive.
The WRC awarded the ex-employee €2,000 in compensation, acknowledging that while company rules were violated, the dismissal was not a proportionate response.
This case highlights issues surrounding employment policies and the responsibilities of both employees and employers in managing staff-related benefits.
